DOLMAN & TAYLOR TERMS AND CONDITIONS

1.1 Any use by you of this website and/or buying from this website means that you have accepted these Terms and Conditions and will be bound by them.
1.2 We may change these Terms and Conditions without letting you know and therefore it is up to you to check this page for any changes.

2.1 This website is operated by Dolman and Taylor.

Definitions

3.1 For the purposes of these Terms and Conditions the following definitions apply:
3.2 Us, We, Our, Ourselves, seller, Company, DAT : Dolman and Taylor
3.3 Goods, Items : The range of products and services which are available for purchase from DAT.
3.4 You, Your, Yourself, Purchaser : The Customer, the person or organisation who is buying goods.
3.5 Contract : The contract for sale of goods by us and purchase of goods by you
3.6 Words denoting the singular shall include the plural and vice versa.

Contract for the Supply of Goods

4.1 After having received your order, we will send you an e-mail ("Order Receipt") confirming receipt of your order and containing the details of your order. Please note that the Order Receipt e-mail is not an acceptance of your order.
4.2 We will then send you a firm quotation which is valid for three months. Occasionally, and without notice manufacturers may discontinue a fabric; we will notify you immediately we are aware this is the case.
4.3 Orders are accepted on receipt of payment of the order value, by making payment you are confirming that all details itemised on our written quotation (sizes, fabrics, linings, heading types etc) are correct.
4.4 No contract for the supply of goods will be deemed to exist between you and 'DAT" unless, and until, a ("Payment Confirmation") e-mail is sent by DAT to you confirming that your order has been paid for.
4.5 You must check that the details of your Payment Confirmation e-mail are correct as soon as possible and you should print out and keep a copy for your records.
4.6 Any goods on the same order which we have not confirmed to have been Paid for in a Payment Confirmation e-mail do not form part of that contract.
4.7 This Payment Confirmation e-mail amounts to an acceptance by 'DAT' of your offer to buy goods from 'DAT" and this acceptance is effective regardless of whether or not you receive the e-mail.
4.8 DAT is free to withdraw from a prospective contract at any time prior to acceptance for any reason. This also applies in the case of any error or inaccuracy in respect of the goods, any description applied to the goods, the availability of the goods or the order itself.
4.9 Price and availability information is subject to change without notice

5.1 All material included on this website, such as text, graphics, logos, and images are protected by United Kingdom and International copyright, trade mark and other laws.
5.2 Your use of the website does not transfer to you any ownership or other rights in the website or its content.
5.3 You are permitted to print or download extracts from this material for your personal use only to assist you in making a purchase from us. No material may be copied, imitated, reproduced, republished, uploaded, posted, transmitted, modified, indexed, catalogued, or distributed in any way, in whole or in part for commercial use or gain.

6.10 We will not be liable to you or in breach of the Contract for delay or failure to perform due to any causes beyond the reasonable control of ourselves or our suppliers, including, but not limited to, acts of God, civil commotion, industrial dispute, riots, flood, and legislation.
6.11 Cords hanging from blinds and curtains can be dangerous (especially to children). It is your responsibility to assess the suitability and fitness for purpose of any goods you purchase from us. If you are unable to carry out this assessment, you should consult someone who can do this for you before putting into use any goods purchased from us.
6.12 All goods are supplied with the understanding that they will be fitted by a qualified experienced person equipped with relevent tools and test equipment necessary to facilitate fitment and confirmation of correct operation.
6.13 We shall be under no liability in respect of any defect in the Goods arising from any inaccuracy in the Customer's Order. We shall have no liability for errors in any Customer's Order and any loss (or otherwise) that may arise there from.
6.14 We shall be under no liability in respect of any defect in the Goods arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow our instructions (whether oral or in writing) or misuse or alteration or repair of the Goods without our approval.

Data Protection

7.1 We only ask you for sufficient personal information to enable the delivery of ordered goods and processing of payment. None of this information will be shared with or disclosed to any third party.
7.2 You agree that the information you provide is true, accurate, current and complete in all respects.
7.3 Any message or information you send to this website may be read or intercepted by others unless there is a special notice that a particular message is encrypted.
7.4 We operate a secure encrypted site where necessary, all Internet transactions are handled by PayPal, we do not store nor have access to your card information.

Prices

8.1 All prices are subject to confirmation at time of order.
8.2 Prices are in UK Pounds Sterling and do not include VAT.
8.3 We give a firm quotation which is valid for three months. Occasionally, and without notice manufacturers may discontinue a fabric; we will notify you immediately we are aware this is the case.
8.4 We reserve the right to change prices and specifications without notice.
8.5 If an incorrect quotation, listing or order confirmation is given at an incorrect price due to a technical, administrative or other reason, we reserve the right to refuse the order whether or not the order has been charged to your credit or debit card, funds received by electronic transfer, cheque or cash. In this instance we will refund the charge in the same manner.

Measuring

9.1 Goods are manufactured in accordance with the measurements provided by you. Please follow the instructions on how to measure which are available on the website. If you are unsure please call us for advice and clarification. We cannot accept the return of goods incorrectly measured by you.

Cancellation and Refunds

10.1 Because all our products are made to measure to your specific measurements and requirements, they cannot be resold and are not subject to the Distance Selling Regulations. It is vital, therefore, that you check order details before confirming your order with us. If you wish to cancel the only opportunity for this is between placing your order (this is when we take payment) and you confirming the order details with us, which we ask you to do by telephone or e-mail. Once order details are confirmed the order cannot be cancelled.
10.2 Consumer Protection (Distance Selling) Regulation 2000
The Distance Selling Regulations, which allow a seven day “cooling off” period after ordering and a right to cancel an order within this period, do not apply to “personalized goods or goods made to a consumer’s specification” thereby excluding all Dolman and Taylor made to measure products.

11.1 Before returning any goods, contact us by telephone, letter or e-mail for returning Instructions

Warranties & Guarantees

12.1 Our products are custom-made according to specifications provided by you and therefore we cannot accept returns or refunds on the products for any aspect of the product which has been determined by you in particular, incorrect measurements, heading, lining or fabric choices.
12.2 We will accept returns and consider replacements or full or partial refunds if there is a significant problem with the quality of manufacture or faults with the fabric. You shall not be entitled to reject the Goods where the alleged defect or breach of contract is so slight that it would be unreasonable for you to do so.
12.3 Any claim by you which is based on any defect in the quality or condition of the Goods or their failure to correspond with the specification should be notified to us on discovery. Any valid claim of this sort shall not be accepted by us unless made within 7 days from the date of delivery of the Goods.
12.4 We will endeavour to repair or replace the defective goods free of charge in a timely manner. If a repair is not possible, you will be offered a replacement and only if a suitable replacement is not available will you be offered a refund.
12.5 We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered goods, over and above the value of the goods themselves. This does not affect your statutory rights.
12.6 Our guarantees are limited to goods sold and retained in the United Kingdom, and used solely for private and domestic purposes.
12.7 Any goods which have been altered, modified, abused or used for any purpose other than that which it was designed for, or not maintained as required in the instructions will not be covered by warranty. Cleaning of fabric may cause shrinkage, fading and staining which will not be covered by warranty.

General

13.1 Our primary method of contact with customers is by e-mail. E-mails to you will be sent to the address you specify to us. It is your responsibility to provide us with a valid e-mail address and to inform us of any changes to that address.
13.2 To the extent that any provision of these terms is found by any court or authority to be invalid, unlawful or unenforceable, that provision will be deemed not to be a part of these terms and will not affect the enforceability of the remainder of these terms, nor will it affect the validity, lawfulness or enforceability of that provision in any other jurisdiction.
13.3 The headings in these terms are for convenience only and do not affect their interpretation. These terms supersede any representation made by us or any of our employees or agents.

Statutory Rights

14.1 Your contract with Dolman and Taylor does not affect your statutory rights.

Governing Law & Jurisdiction

15.1 These terms and your use of this website are governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the Courts of England and Wales.
